The Damn Weather, operated by Hivewerks, LLC ("we," "our," or "the app"), is committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights regarding that information.

The short version: We collect your location to show you the weather. That data goes to Apple to fetch your forecast. We don't track you, we don't sell your data, and we don't use third-party analytics or advertising. That's it.

1. Information We Collect

1.1 Location Data

When you grant permission, we collect your device's precise location (latitude and longitude) to provide accurate weather forecasts for your area. We request location access only while the app is in use ("When In Use" permission).

1.2 Saved Locations

If you save cities for quick access, the city name, state, country, and coordinates are stored locally on your device. This data never leaves your device.

1.3 User Preferences

Your settings (temperature unit, wind speed unit, phrase mode, notification preferences, etc.) are stored locally on your device using standard iOS storage. This data never leaves your device.

1.4 Cached Weather Data

Weather forecasts and related data are temporarily cached on your device to improve performance and power widget displays. This cached data is stored locally and never transmitted to external servers.

3. Third-Party Services

3.1 Apple WeatherKit

To retrieve weather data, your location coordinates (latitude and longitude) are sent to Apple's WeatherKit service. Apple processes this data according to their own privacy policy. Your location is not linked to your identity when sent to WeatherKit.

3.2 Apple Maps

We use Apple's MapKit framework to convert your coordinates into a readable location name (reverse geocoding) and to power location search. Apple processes this data according to their privacy policy.

3.3 No Other Third Parties

We do not use any third-party analytics services, advertising networks, crash reporting tools, social media SDKs, or data brokers. Your data is never sold, rented, shared with, or disclosed to any third party beyond the Apple services described above.

All user data (preferences, saved locations, cached weather) is stored exclusively on your device. We do not operate servers that store your personal information. We do not have a backend, database, or cloud service that receives your data.

5. Widgets and Notifications

5.1 Home Screen Widgets

Widgets display cached weather data that is shared between the main app and the widget through a secure, on-device App Group container. No data is transmitted to external servers for widget functionality.

5.2 Notifications

If you enable notifications, the app schedules local notifications on your device for morning weather forecasts and severe weather alerts. These notifications are generated entirely on your device. No push notification servers or external services are used.

7.1 Location Permission

You can revoke location access at any time through your device's Settings > Privacy & Security > Location Services. The app will continue to function with manually searched locations if you deny or revoke location permission.

Legal basis for processing: We process your location data based on your explicit consent (granted through the iOS location permission prompt). You may withdraw this consent at any time.

If you believe your rights have been violated, you have the right to lodge a complaint with your local data protection supervisory authority.

Precise geolocation is classified as sensitive personal information under the CPRA. We collect it solely for the purpose of providing weather forecasts, and you may limit this use by revoking location permission.

7.5 Rights Under Other Jurisdictions

We respect privacy rights globally. If you are located in Canada (PIPEDA), Brazil (LGPD), South Africa (POPIA), Australia, New Zealand, Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), or any other jurisdiction with applicable privacy laws, you have similar rights to access, correct, and delete your data as described above. Since all data is stored locally on your device, you can exercise these rights directly without contacting us.

8. Children's Privacy

The Damn Weather is rated 16+ due to optional explicit language content. The app defaults to clean mode with no profanity. Explicit mode requires a separate age confirmation before activation.

We do not knowingly collect personal information from children under 13 (or under the applicable age in your jurisdiction) beyond the location data necessary for weather functionality, which is collected with the device owner's consent via the iOS permission system.

9. Data We Share With Apple

The only data that leaves your device is your location coordinates, sent to Apple's services:

10. Do Not Sell or Share

We do not sell your personal information. We do not share your personal information with third parties for their marketing purposes. We have never sold or shared personal information, and we have no plans to do so.

11. International Data Transfers

When your location is sent to Apple WeatherKit and Apple MapKit, it may be processed on Apple's servers located in various countries. These transfers are governed by Apple's privacy practices and data protection agreements. We do not independently transfer your data across borders, as we do not operate any servers.

We may update this privacy policy from time to time. If we make material changes to how we handle your information, we will update the "Effective Date" at the top of this page. We encourage you to review this policy periodically. Your continued use of the app after changes are posted constitutes your acceptance of the updated policy.
